Leatherwood Property Owners - Board Meeting
July 22, 2006
Present: Chuck Mann, Randy Burke, Leila Ivey,
David Beckett, Delaine Parker, Diane Ertel, George Mast,
and guest Gayle Mast.
Chuck Mann called the meeting to order at 10:00 a.m.,
requesting a reading of last month’s minutes for
approval. Corrections were made as necessary and Randy
Burke made a motion to approve the minutes with Delaine
Parker seconding the motion. Motion passed.
Contracts and Agreements: Chuck Mann reported
that he and Delaine were waiting on Gary Gibson to start
on the culverts. The mowing is continuing between rain
showers.
On another issue, Diane Ertel reported that Leatherwood
Rentals had requested approval from the Board to rent
from the POA the grassy area in front of the pool for
weddings. George Mast informed the Board that our
insurance would apply in any liability issues. Questions
were raised about parking, use of the pool, interference
with pool activities, the number of weddings planned,
damage to the area, and security. The question was
raised about rainy day weddings. After discussing the
issues involved, it was decided to table the matter
until further information could be obtained from
Leatherwood Rentals.
Roads: Chuck Mann reported that he and Delaine
Parker are working on getting a contractor to pave
Granny’s Ridge Rd. A conduit in the Elk Horn phase was
already broken where Blue Ridge Electric was putting in
power. Mike Everett will be contacted about whom to talk
to about the damage. Delaine reported on a safety issue
concerning the fact that West Ridge Drive is one lane,
with no shoulders, and numerous blind curves and hills.
There have already been several encounters of “near
misses” when riders were in the middle of the road.
After discussions with Abbie Hanchey concerning these
dangers, and the fact there is an existing trail the
entire length of West Ridge Drive, it was decided to
place signs at three different locations on West Ridge
asking riders to stay on the trail. Unfortunately,
someone removed the signs, requiring new signs to be
made.
Covenant Compliance Committee: David Beckett said
that he had not had another meeting of his committee
because he had learned that a Board member had left the
last meeting and had criticized the work of the
committee to several people. This was after the Board
had given a vote of full confidence to the work the
committee was doing. The biggest issues have been of
non-compliance by some property owners. The Board felt
strongly that unless the violations are addressed now
that the community will be so large it will be hard to
enforce the covenants at a later date. Randy Burke
stated that there will always be disagreement among
special interest groups but that the covenants are in
place to protect the community as a whole and to
preserve a certain atmosphere in Leatherwood. It is the
Board’s duty to make sure that everyone complies with
all of the covenants evenly. He emphasized that if the
majority of homeowners do not like an enforcement, they
can vote against it at the next annual meeting. All
Board members agreed that the section of the covenants
referring to Nuisance and Annoyance issues are the
hardest to define.
The Board instructed David Beckett to continue working
on these problems and to report back at the next meeting
on the committee’s progress.
Laurelmor and Leatherwood: Chuck Mann reported
that he, Mike Everett and David Beckett had met with an
attorney, Anthony di Santi, for advice concerning
several issues involved with the proposed purchase of
amenities outside the gate by Ginn. The main discussion
concerned roads, trails and easements, and clarification
about the covenants. The attorney asked for some time to
do research on the questions raised and another meeting
was planned. Since Randy Burke has returned after an
extensive vacation, Delaine Parker made a motion that
Chuck Mann and Randy Burke be our exclusive
representatives in future meetings with Mr. di Santi.
The motion was seconded and passed unanimously.
Fire Department: Delaine Parker reported that the
company who is supplying the building for the volunteer
fire department substation at Elk Creek/Tripplett Roads
has had several delays in delivering the building, but
it is coming.
Entertainment: Diane Ertel reported that plans
had been completed for the Community Yard Sale to
benefit the volunteer fire department. Donations for the
sale had already started and all of her committee had
their jobs assigned. There would be a lot of help from
Rock Springs Baptist Church and the community as a
whole. A successful sale was anticipated. The dates were
given for future events, including the fly fishing
lessons planned for the 26th and 27th of August, the
winery concerts, and the New Year’s Eve Cruise. Diane
said that cabins were quickly selling out on the cruise
ship and that it was important for anyone planning to go
to make reservations now.
Reservations for the play, dinner, and overnight stay at
the Martha Washington Inn also needed to be made as soon
as possible. Only a few rooms were left at the Inn.
A motion was made to adjourn, was seconded, and passed.
